Creator & Builder Agreement

1. Scope

This Creator & Builder Agreement ("Agreement") governs your use of GateStack as an operator, builder, or creator. By accessing the GateStack platform and creating projects, sessions, or deploying AI builders, you agree to be bound by this Agreement in addition to the GateStack Terms of Service.

2. Ownership of Your Work

You retain full ownership of all code, configurations, prompts, scope contracts, and other intellectual property you create using GateStack. GateStack does not claim any ownership rights over your projects, outputs, or data. Your code is your code.

3. License Grant to GateStack

You grant GateStack a limited, non-exclusive, revocable license to process your project data solely for the purpose of delivering the GateStack service to you. This includes executing builder actions, running Watchman analysis, generating Time Machine snapshots, and displaying gate approval requests. We will never use your project data to train AI models or share it with third parties.

4. Operator Responsibilities

As a GateStack operator, you agree to:

  • Use the platform only for lawful purposes and in compliance with all applicable laws and regulations.
  • Not use AI builders to generate malware, exploit code, or content that violates the rights of others.
  • Not attempt to circumvent approval gates, Watchman protections, or other safety mechanisms.
  • Not share your API keys or grant unauthorized access to your workspace.
  • Accept responsibility for all actions approved through your gate approvals, including those delegated to team members.
  • Maintain accurate account information and promptly report any unauthorized access.

5. Builder Conduct

AI builders operating within your GateStack sessions are constrained by the scope contracts you define. You acknowledge that AI builders may occasionally produce incorrect, incomplete, or suboptimal code. The approval gate system exists to catch these issues before they reach your codebase. GateStack is not liable for approved actions that cause issues in your project.

6. Data Handling

Project data including source code, configurations, and session logs is encrypted at rest and in transit. Time Machine snapshots are stored for the duration specified by your plan (7 days Solo, 30 days Founder, 90 days Studio, unlimited Enterprise). After expiration, snapshots are permanently deleted.

7. Acceptable Use

You may not use GateStack to:

  • Generate code intended to harm, exploit, or compromise systems you do not own or have authorization to test.
  • Produce content that infringes copyrights, trademarks, or other intellectual property rights.
  • Engage in activities that violate export control laws or sanctions.
  • Overload the platform infrastructure through excessive or abusive API usage beyond your plan limits.

8. Termination

Either party may terminate this Agreement at any time. You may close your account through Account Settings. GateStack may suspend or terminate your access if you violate this Agreement, with notice provided to the email on file. Upon termination, you have 30 days to export your project data. After 30 days, all data is permanently deleted.

9. Limitation of Liability

GateStack provides tools to assist development, not guarantees of code correctness. You are responsible for testing, reviewing, and validating all code produced within GateStack sessions before deploying to production environments. GateStack's liability is limited to the fees paid by you in the twelve months preceding the claim.

10. Governing Law

This Agreement shall be governed by the laws of the State of Illinois, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in Cook County, Illinois.
